Check My Ads Institute Applauds Landmark Ruling Declaring Google an Illegal Monopolist in Ad Tech
April 17, 2025

Check My Ads Institute commends Judge Brinkema's landmark ruling that Google has unlawfully monopolized key sectors of the digital advertising market. This ruling affirms that for over a decade, Google engaged in anticompetitive conduct to secure and maintain monopoly power in the publisher ad server and ad exchange markets.
“For years, we've witnessed how Google's unchecked power has distorted the ad tech ecosystem, disadvantaging publishers, advertisers, and ultimately, consumers,” said Policy Director, Sarah Kay Wiley. “Today, we are one monumental step closer to a fair and competitive digital advertising market.”
The court found that Google's conduct in monopolizing the publisher ad server and ad exchange markets violated antitrust laws. Notably, Judge Brinkema deemed Google’s central arguments — including the contention that the digital advertising market operates a single two-sided market — to be unpersuasive.
"We are thrilled that Judge Brinkema saw Google’s disingenuous justifications around safety, security, and quality for what they were: pretextual,” said Check My Ads COO, Arielle Garcia. “This ruling is a clear victory for the industry and the public at large.”
Check My Ads Institute has long advocated for transparency and accountability in digital advertising. Dismantling Google’s monopoly is a crucial step for establishing healthier market norms.
We urge lawmakers and industry stakeholders to build upon this decision, toward a future where the digital advertising market operates with transparency, fosters competition, and respects consumer rights.
